TERMS & CONDITIONS FOR TOWNSEND 360 AND GRAND-FATHERED GOLD GUARD
General Conditions
- Service plan coverage is contingent on inspection of the heating system by Townsend Energy.
- Townsend Energy reserves the right to inspect all heating equipment and refuse to perform any service or repair work on equipment deemed unsatisfactory.
- Service performed that is not explicitly listed on the contract will be charged at the prevailing rate.
- Townsend Energy reserves the right to cancel the plan upon 10 days written notice.
- The customer's account must not be in arrears by more than 59 days to be considered in good standing.
- It is the customer's responsibility to contact Townsend to arrange their tune-up. Tune-ups are scheduled by appointment only during normal business hours. Townsend 360 includes one annual tune-up or inspection of a customer's heating, cooling, plumbing, or electrical system. If a customer has multiple condensers or heating systems, only one will be tuned up under the provision of the membership; additional systems will be charged accordingly. The customer's right to the tune-up expires at the end of each coverage year, and no credit will be issued if the tune-up is not performed.
- At membership renewal, the customer must identify the unit that will be tuned up that year and covered by the membership; otherwise, the equipment covered by the membership will default to the heating unit. The customer can change that designation each year, and can also arrange for tune-ups of other units at a 15% discount off regular rates. If a customer has multiple condensers, boilers, water heaters, etc., each is considered a separate "unit."
- Fuel tanks and generators are not covered under the Townsend 360 membership. For fuel tanks and generators, please refer to plans specifically designed for this equipment.
- Units that are covered under Townsend 360 include heating oil, propane, and natural gas boilers and furnaces; electric heat pumps and baseboard; central air conditioners and ductless mini-splits; oil, propane, natural gas, and electric water heaters; and plumbing and electrical inspections.
- With Townsend 360 you receive 15% off parts and labor on your home services needs, which includes service work performed on oil and propane boilers and furnaces, electric heat pumps and baseboard, central air conditioners, ductless mini-splits, oil/propane/natural gas/electric water heaters, and plumbing and electrical work.
- Townsend Loyalty Credits are accumulated at a rate of $50 per year, up to $500, for every year you purchase a Townsend 360 service plan. Up to $500 may be used towards replacement of a boiler, furnace, or central air conditioner. Up to $250 may be used towards replacement of a water heater or upgrade of an electrical panel. Credits only have value towards purchasing new heating, cooling, plumbing, or electrical systems from Townsend, cannot be applied to fuel purchases or equipment repair, and have no redeemable cash value. Credits reset to $0 if a customer terminates Townsend 360.
- The length of this service plan is one year. It will automatically renew at that time unless Townsend Energy is notified of cancellation in writing thirty (30) days prior.
Other Conditions
Townsend Energy will not accept responsibility for the loss of heat in any unoccupied buildings, or for delay or damages resulting from fires, accidents, power interruptions, water in basement, water in storage tank and/or lines, labor difficulties, acts of the Government, flood, war, hurricanes, earthquakes, or any acts of God, or other causes beyond our control; or for any loss or damage caused directly or indirectly by services performed, or for any consequential or special damage of any kind whatsoever, for any reason.
Exclusions
- This agreement provides a 15% discount on any repair work we do. It does not cover replacement of a complete boiler, furnace, burner, hot water heater (indirect or oil-fired), mechanical chimney (power venter), tankless coil, radiant heat, humidifier, piping, baffles, oil lines, oil storage tanks, auxiliary lift pumps, electric wiring, domestic plumbing, draining of expansion tanks, purging of radiators, or any parts or services not explicitly mentioned in this agreement.
- Townsend Energy is not liable for any environmental pollution or pollution cleanup due to tank rupture, oil line leak, or any contamination resulting from the oil distribution system.
- This service plan is for ordinary residential systems up to 5 tons of cooling. Talk to our representatives about coverage for commercial-grade heating, cooling, plumbing, and electrical systems.
- Townsend 360 covers all work we perform for heating, cooling, plumbing, and electrical systems. It does not cover repairs that our team is not equipped to make.
